Terms and Conditions
1. Scope
These terms and conditions apply to all competitions conducted by KP Family International GmbH, Einsteinring 1-7, 85609 Aschheim (hereinafter referred to as the “Organizer”). By participating, every participant acknowledges these terms and conditions.
2. Participation
2.1 All natural persons acting in their own name and aged 18 or older are eligible to participate. Participants who have reached the age of 16 but are not yet of legal age may only participate with the consent of their legal guardians.
2.2 Minors under the age of 16 and individuals incapable of business transactions are excluded from participation.
2.3 The Organizer reserves the right to exclude persons from participation if they violate these terms and conditions or attempt to gain an unfair advantage through improper influence or manipulation. The Organizer may also retrospectively exclude such participants from the competition, revoke prizes, and demand their return.
2.4 Participation is only possible within the period specified in the competition description. Each participant may only participate once in an identical competition.
2.5 Employees of the Organizer, as well as employees of companies involved in the competition and their immediate family members, are excluded from participation.
3. Execution of the Competition
3.1 Participation in the competition requires the complete filling out of the entry form. This includes first name, email address, checking the box to subscribe to the newsletter ("Kükenpost"), and checking the box to participate in the competition. If further conditions for participation are necessary, they will be stated directly within the competition entry process. The competition will be conducted during the specified period. All participants who meet the conditions outlined in Sections 2 and 3 by the time of the draw will be considered. The winner will be selected by random draw immediately after the participation period ends.
3.2 Changes to or cash payouts of the prize are excluded. Prizes are non-transferable.
4. Prize Processing
4.1 The winner will be notified by email by the Organizer. The winner must inform the Organizer within one month of receiving the notification whether they accept the prize. If no response is received within this period, the claim to the prize expires, and the Organizer reserves the right to determine and notify a new winner.
4.2 If the participant’s provided contact information is incorrect (e.g., email address), the Organizer is not obligated to determine the correct details. Any disadvantages arising from incorrect contact details are the responsibility of the participant.
4.3 In the event of a voucher being the prize, the entitlement to the voucher also expires if it cannot be delivered within six months of the first notification due to reasons attributable to the winner, irrespective of Section 4.1.
5. Liability for Defects
The Organizer is only liable for damages resulting from material and/or legal defects in cases of intent, gross negligence, or fraud. Any further liability for material and/or legal defects is excluded.
6. Early Termination, Adjustment, or Modification of the Competition
The Organizer reserves the right to terminate, adjust, or modify the competition at any time without prior notice and without stating reasons, particularly if the proper execution of the competition cannot be guaranteed due to technical or legal reasons.
7. Applicable Law
All legal relationships between the parties are governed by the laws of the Federal Republic of Germany. For consumers, this choice of law applies only to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer resides.

8.1 Processing of Personal Data for the Competition
We process your personal data for the proper execution and handling of the competition, specifically for the delivery of prizes.
To execute the competition, we collect and store the participant’s first and last name and email address. For prize delivery, we also collect the winner’s address and pass it on to a shipping company we commission. Your data will not be shared with third parties beyond this.
The legal basis for this data processing is Article 6(1)(b) GDPR (performance of pre-contractual measures and contract fulfillment).
If we separately publish the winner’s first and last name on our profile or fan page, or externally, such as in our online shop, this will only occur with the prior express consent of the winner under Article 6(1)(a) GDPR.
If participation in the competition is contingent on subscribing to our newsletter or involves a separate newsletter registration, we process your email address for the purpose of sending the newsletter. We use the double opt-in procedure for this purpose, meaning we will only send newsletters after you have confirmed your explicit consent in accordance with Article 6(1)(a) GDPR. This is done via a confirmation email where you must click a link to confirm.
You can unsubscribe from the newsletter at any time using the link provided in the newsletter or by contacting the aforementioned data controller. Upon unsubscribing, we will cease sending newsletters and delete your email address and any related data unless you have expressly consented to further use or a lawful basis exists for continued processing.
8.2 Retention Period
After the competition ends, your personal data processed for the competition will be deleted within three months unless a valid consent for further processing exists (e.g., for the newsletter) and/or we have a legitimate interest in further retention.
8.3 Your Rights
The applicable data protection law grants you the following rights:
• **Right of access (Art. 15 GDPR):**
You have the right to obtain information about the personal data we process about you, the purposes of processing, the categories of personal data processed, the recipients of your data, the retention period, your rights regarding rectification, erasure, restriction of processing, objections, complaints, data origin (if not provided by you), automated decision-making, and guarantees for data transfer to third countries.
• **Right to rectification (Art. 16 GDPR):**
You have the right to correct inaccurate data or complete incomplete data.
• **Right to erasure (Art. 17 GDPR):**
You can request deletion of your data under certain conditions.
• **Right to restriction (Art. 18 GDPR):**
You may request restriction of data processing under certain conditions.
• **Right to notification (Art. 19 GDPR):**
You have the right to be informed about any corrections, erasures, or restrictions regarding your data.
• **Right to data portability (Art. 20 GDPR):**
You have the right to receive your data in a structured format or have it transferred to another controller.
• **Right to withdraw consent (Art. 7(3) GDPR):**
You can withdraw your consent for future data processing at any time.
• **Right to lodge a complaint (Art. 77 GDPR):**
You can lodge a complaint with a supervisory authority if you believe your data processing violates GDPR.
By participating in the competition, you agree to the processing of your data in accordance with this privacy notice.
